Terms of service

These terms govern your use of drcellx.com and any order you place on it. The store is operated by Bloomkare, Inc., 412 Red Hill Ave #B, San Anselmo, CA 94960, USA ("Bloomkare", "we", "us"). By using the site or placing an order you agree to them. If you don't, please don't use the site.

1. Who can order

You must be at least 18, or have a parent or guardian's permission and supervision, and you must give accurate, complete billing and shipping details.

We ship within the United States only at present.

2. Orders and acceptance

Placing an order is an offer to buy. We accept it when we send your shipping confirmation — that's when the contract forms. Until then we may decline or cancel an order, and we'll refund you in full if we do. Reasons include:

• the item is out of stock;
• a pricing or description error (see section 3);
• we can't authorise your payment;
• we suspect fraud, resale, or a breach of these terms;
• we can't ship to the address given.

We may limit quantities per person, per household, or per order.

3. Prices and errors

Prices are in U.S. dollars and exclude tax, which is calculated at checkout. We can change prices at any time, but never after we've accepted your order.

We try hard to be accurate, but if a product is listed at an obviously wrong price or with a materially wrong description, we may cancel affected orders even after confirming them, and we'll refund you in full. We'll always contact you first.

4. Payment

Payment is taken at checkout through our payment processors. We don't store your full card details. By submitting payment details you confirm you're authorised to use that method.

5. The product

Dr.CellX products are cosmetics, not medicines. They are not intended to diagnose, treat, cure, or prevent any disease.

• Use only as directed on the package and the product page.
• For external use only. Avoid the eye area. Do not use on broken or irritated skin. Stop use if redness, swelling, irritation, or discomfort occurs, and see a physician if symptoms persist. Keep out of reach of children. Store away from direct sunlight.
• Read the full ingredients before use if you have allergies or sensitivities.
• Results vary between people. Claims on this site describe typical or tested outcomes, not a promise about your skin.

If you have a reaction, stop using it and email hello@drcellx.com with photos and the batch number from the bottom of the package.

6. Shipping, returns, and the guarantee

Covered by our Shipping policy and Refund policy, both of which form part of these terms.

7. Subscriptions

Subscribe & Save renews automatically every 2 weeks at the discounted price until you cancel. You may skip, pause, or cancel at any time from your account, free of charge. Changes at least 24 hours before a renewal apply to that renewal. We'll email you before each renewal and if the price ever changes.

8. Accounts

Keep your password to yourself; you're responsible for activity under your account. Tell us at hello@drcellx.com if you think someone else has access. We may suspend an account that breaches these terms.

9. Acceptable use

Don't use the site to break the law, infringe anyone's rights, scrape or mine it, interfere with its operation or security, resell our products without written permission, or submit false or misleading reviews.

10. Content you submit

If you send us a review, photo, or message, you keep ownership, but you give us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it in connection with the brand, including in marketing. Only submit content you have the right to share. We can remove any submission for any reason.

11. Our content

Everything on the site — text, images, logos, the Dr.CellX name and marks, design, and code — belongs to Bloomkare or our licensors and is protected by intellectual-property law. You may view and share it personally; you may not copy it commercially without written permission.

12. Third-party links

The site links to third-party services (payment, reviews, social). We're not responsible for their content or practices, and their terms and privacy policies apply when you use them.

13. Disclaimers

The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted or error-free.

Nothing here excludes liability for fraud, personal injury caused by our negligence, or anything else that can't be excluded by law.

14. Limitation of liability

To the fullest extent the law allows, Bloomkare is not liable for indirect, incidental, special, or consequential damages, or lost profits or data, arising from the site or a product. Our total liability for any claim is limited to the amount you paid for the order it concerns.

Some states don't allow these limits, in which case they apply only as far as that state permits.

15. Indemnity

You agree to indemnify Bloomkare against claims and costs arising from your breach of these terms or your misuse of the site.

16. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and the state and federal courts in Marin County, California have exclusive jurisdiction over any dispute arising from them.

17. Changes

We may update these terms. The date at the top shows the current version, and the terms in force when you ordered are the ones that apply to that order.
